General Terms and Conditions of PA Mental Coaching
Scope These general terms and conditions (AGB) apply to all business transactions between Patrick Altendorfer and his clients. They apply for the duration of the business relationship. By booking an appointment, these conditions are considered accepted. Any deviations from these terms and conditions must be agreed upon in writing in advance.
Definitions:
1:1 Coaching: 60 minutes of individual 1:1 coaching, either virtual or physical, as agreed with the client. On-site coaching sessions take place at the premises of PA Mental Coaching.
WhatsApp Support and inclusive of any telephone support: Availability upon agreement. PA Mental Coaching cannot guarantee acceptance of requested appointments by clients. PA Mental Coaching commits to finding an alternative date within 14 days of the desired date.
Competition support/training support: Maximum 2 hours of on-site support. Additional costs such as entry fees, tickets, or others will be borne by the clients. Free travel is provided up to a maximum of 60 km from Zurich.
Client's Responsibilities Coaching is based on discussions between the parties. It relies on collaborative efforts based on mutual trust. Coaching is a voluntary, active, and self-responsible process, with specific outcomes not guaranteed. Patrick Altendorfer acts as a supportive process facilitator. The actual work of change, however, is carried out by the clients. Clients should be willing and open to engage with themselves and their situations. Clients bear responsibility for their decisions and actions within and outside of coaching services.
Terms and Conditions For private clients: Unless otherwise agreed in writing, prices quoted by Patrick Altendorfer at the time of booking apply. Payment is due at the end of each session in Swiss Francs (CHF), in cash, via Twint, or as agreed upon invoicing. Invoices are typically issued at the end of the month and are payable within 10 days. Incurred travel expenses are separately agreed upon with the client and generally involve second-class public transport.
For business clients: Prices are provided in an individual offer. Payment is due in Swiss Francs via invoice. Invoices are typically issued at the end of the month and are payable within 10 days. Incurred travel expenses are separately agreed upon with the customer. A flat rate is established for travel time, typically involving first-class public transport. For indefinite offers, the price commitment expires 3 months after the offer date.
Expenses such as special tools (e.g., personality profiles), external room rentals, and other external costs are agreed upon in advance with the customer and invoiced separately.
Appointments, Cancellation Terms, and Cancellation Appointments are arranged upon request and as needed. Cancellation or rescheduling of coaching sessions is free of charge up to 24 hours before the appointment, or until Friday 5:00 PM for Monday appointments. For cancellations or reschedulings with shorter notice, the full fee is due and invoiced.
If a session is canceled or rescheduled by Patrick Altendorfer, the client will receive a refund for the portion of the work not yet performed. An alternative appointment will be offered if possible. Further claims due to a canceled appointment by Patrick Altendorfer are excluded.
Confidentiality Patrick Altendorfer undertakes to maintain confidentiality regarding all operational, business, and private matters of clients even after the termination of the contract. Parties may agree to disclose certain information to specific third parties. Disclosure of information may be subject to mandatory legal requirements or governmental orders. For quality assurance purposes, Patrick Altendorfer is entitled to keep a journal and to anonymize coaching situations for intervision or supervision.
Intellectual Property Unless expressly agreed otherwise in writing, all intellectual property rights, particularly copyrights, to content created by Patrick Altendorfer such as presentations, drawings, illustrations, plans, photographs, designs, brochures, texts, regardless of their protectability and form (including as data), remain exclusively with Patrick Altendorfer. Nothing in these terms and conditions shall be construed as granting third parties any rights to use Patrick Altendorfer's intellectual property. Patrick Altendorfer excludes any liability for damages caused to third parties by authorized or unauthorized use of Patrick Altendorfer's intellectual property rights, to the extent permitted by law.
Liability Patrick Altendorfer's services are purely advisory. Patrick Altendorfer assures clients or their clients a professional and careful execution of the work. Success is neither guaranteed nor owed. Any liability is excluded.
The transmission or electronic transfer of any data is at the client's own risk.
The coaching services offered are not a substitute for any necessary medical or psychiatric treatments and therapies. Participation in coaching requires normal mental and physical resilience. It is legally emphasized that coaching does not promise healing and coaching sessions do not replace visits to a physician, healer, psychiatrist, psychologist, and/or psychotherapist. Coaching sessions also do not replace medication therapies prescribed by a physician, healer, psychiatrist, psychologist, and/or psychotherapist. Patrick Altendorfer also does not make diagnoses, as these can only be made by physicians, naturopaths, psychiatrists, psychologists, and/or psychotherapists. If the client is currently undergoing medical treatment, it should not be interrupted or discontinued. Clients are responsible for utilizing all opportunities of collaborative work to their best advantage.
Insurance Coverage Insurance coverage is solely the responsibility of the client. Patrick Altendorfer does not provide insurance coverage.
Jurisdiction Jurisdiction is Zurich. Swiss law applies.
Final Provision Should any provision or appendix of the agreement with clients be or become invalid, the validity of the remaining agreement shall not be affected. The parties shall replace the invalid provision with an effective provision that most closely achieves the intended economic purpose of the original provision. The same applies to any gaps in the agreement.
